Wow, I recently have been trading e-mails with someone with, honestly, message board mentality in an attempt to argue with me the legalities of parody and trademark. So, to be more concise, let me rephrase. I was technically incorrect when I said it was illegal to claim parody on a trademark. However, for all extents and purposes, it's so difficult to parody a trademark, you might as well also say "It's possible to walk through a mine field with a pair of lead boots." So it's not illegal, just realllllly hard. Especially with someone with full rights to defend their trademark. To be more clear, you can parody a copyright and if you get taken to court, you can claim parody and copyright will defend itself and you'll be set free. The difference between trademark and copyright is that trademark has to be defended in order for it to have any strength; trademarks do not defend themselves. So, in this case, American's Greetings was defending their trademark which is in their right to do. Please, don't tell me it was fair use or parody; you don't own Strawberry Shortcake, so you can't claim the amount of damage done by you. American's Greetings owns her trademark and they defended their trademark. You would do the same to a character you owned. If you don't believe me, you are either A) A raving fanboy who likes supporting the underdog or B) never had anything in your life you ever cared about enough to defend or have never created any characters or ideas that you can call your own. In either case, if you want to argue the legalities of trademark vs. copyright, do so with intelligence, not with message board mentality, please. I'm tired of mental masturbation. I had to deal with it when I was in college at USC... I also had to deal with it when dealing with my brother and his friends at Caltech.

May 5, 2003 - Monday

*coff*coff* So, excuse my lack of updates lately.. I'm very close to dying... or at least a miserable existance for a few days =} This weekend was cool though... Stu, George, and Amanda dropped by and we hung out for the weekend... heck, even E graced us with a visit to hang for a while! Yay! But I seem to be coming down with a cold of some sort... I hope I don't get anyone else sick. For most of the weekend, I had felt fine.. but once everyone left, I took a short nap and woke up feeling like utter crap. So now I sit here coughing out my lungs occasionally, sinuses draining. Bleah. But, I know that doesn't excuse the lack of comic, however, I hope my products will appease you. Soon, I'll put up photos of what I plan to bring with me to Acen. I have about 160 shirts, 80 black, 80 white, 30 mouse pads, about 500+ prints (haven't counted =O_o=), about 700 laminated cards, and about 600 CDs. Hopefully, I can pack it all. =} And hopefully, I'll be able to make a costume in time =} Anyway, it's late and I should get some rest. See ya all on the flip side nyo

Hey all, Yea Young has been a very very busy kitty. I think everyone will be very happy when they see all the new product that Young has produced. Wow... my semester is almost up... and when I look back upon these past few months its almost overwhelming. I've been through a lot, I've put other people through a lot and I've accomplished a lot. All in all, things are looking rather positive for me. I just need to make sure I share some of that positive ness with master Young. It's almost summer everyone... give it your best.
